while I agree that it should not ... I have have seen that argument so 
often and in the end something broke after all with the most harmless 
change that one could imagine

anyway, it seems to work without affecting anything in the LaTeX test 
suite and so I added it into the kernel -- not sure it will make it into 
the upcoming release though
